When you purchase a property, a title search is conducted to ensure that the title is clear of any issues. Despite thorough searches, some problems may not be discovered until after the purchase. This is where title insurance comes into play. It provides coverage for any undiscovered issues that may arise, ensuring that your ownership rights are protected.

Residential title policy insurance offers numerous benefits to homebuyers. One of the primary advantages is the protection it provides against unexpected legal claims. If a previous owner has unresolved debts or legal disputes involving the property, title insurance covers the legal fees and other associated costs to resolve these issues.

Title insurance covers a range of potential issues that could affect your ownership rights. One common issue is undisclosed heirs. In some cases, a property may be sold without all rightful heirs being accounted for. If an heir comes forward after the sale, they could claim ownership of the property.

Another issue is forgery or fraud in the property’s history. If a previous owner forged documents or committed fraud to gain ownership, the title insurance would protect you against any resulting claims. Additionally, errors in public records, such as incorrect legal descriptions or recording mistakes, are also covered.

Encumbrances, such as unpaid property taxes or contractor liens, can also pose problems. If these encumbrances were not discovered during the title search, the insurance would cover the costs to settle these claims, ensuring your ownership is not jeopardised.

Making an Informed Decision

Before purchasing a home, it’s essential to understand the importance of title insurance. This form of protection can save you from costly legal battles and potential loss of property. While the initial cost may seem like an added expense, the peace of mind it provides is invaluable.

Work with a knowledgeable real estate agent or attorney to ensure that you are fully informed about the benefits and coverage options available. They can guide you through the process and help you make the best decision for your specific situation.

It ensures that your investment is protected and provides you with the confidence to move forward with your purchase.
